Terms & Conditions

Clear terms.
Responsible use.

These terms apply to the Nadir Vanguard website and to our SMS communications program.

Operator and acceptance

This website is operated by NADIR VANGUARD HOLDING LIMITED, a private company limited by shares incorporated in England and Wales under company number 16879313, with registered office at 167–169 Great Portland Street, 5th Floor, London W1W 5PF (“Nadir Vanguard”, “we”, “us” or “our”).

By accessing or using this website, you agree to these Terms & Conditions. If you do not agree, please do not use the website.

Information only

The website provides general institutional information. Nothing on it constitutes legal, tax, financial, investment or other regulated advice, a recommendation, an offer or solicitation to buy or sell any investment, security, product or service, or a commitment to enter into any transaction or engagement.

You should obtain independent professional advice and make your own assessment before relying on information relevant to a decision. Any mandate, investment, partnership, project or service is subject to due diligence, applicable law and separate written agreements signed by the appropriate parties.

Projects and forward-looking information

References to projects, products, ventures, technologies, strategies, opportunities, forecasts or future capabilities may describe concepts under evaluation or development. They are not guarantees, promises or statements that a project will proceed, be funded, achieve a particular result or become available on a stated timetable. Actual outcomes may differ materially as circumstances, assumptions, approvals and market conditions change.

Permitted use

You may use this website for lawful informational and communication purposes. You must not interfere with its operation; attempt unauthorised access; introduce malicious code; probe or circumvent security; impersonate another person; misuse forms; harvest personal data; systematically scrape protected content; or use the website in a way that infringes our rights or the rights of others.

Intellectual property

Unless stated otherwise, the website, branding, text, graphics, images and other materials are owned by or licensed to Nadir Vanguard. You may view them for personal or internal business reference, but may not reproduce, distribute, modify or commercially exploit them without prior written permission.

Information you submit

Do not send confidential, privileged, security-sensitive or commercially restricted information through the public website unless we have expressly agreed an appropriate channel. Submitting an enquiry does not create an advisory, fiduciary, client, partnership or other professional relationship. We will handle personal data as described in our Privacy Notice; other submissions may be used to assess and respond to the enquiry.

Third-party services

The website may link to or rely on third-party services. Their availability, content, security and practices are controlled by their respective providers. Links do not imply endorsement, and your use of third-party services may be subject to separate terms and privacy notices.

Security and availability

We take reasonable steps to protect the website, but internet communications are not completely secure. We do not guarantee that access will be uninterrupted, that content will always be current or complete, or that the website will be free from errors or harmful components. You are responsible for using suitable security controls on your own devices and networks.

Compliance

You must not use the website or our materials in breach of applicable laws, sanctions, export controls, anti-bribery, anti-money-laundering or other compliance requirements. We may decline, suspend or stop communications or an engagement where reasonably necessary for legal, regulatory, security or risk-management reasons.

Liability

To the maximum extent permitted by law, we exclude implied warranties relating to this website and are not liable for indirect, incidental, special or consequential loss, or loss of profit, revenue, opportunity, data or goodwill, arising from use of or inability to use it. Nothing in these terms excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.

If you use the website for business purposes, you are responsible for losses caused by your unlawful use, infringement of third-party rights or breach of these terms.

SMS program

Nadir Vanguard is developing the NV Connect application and may introduce SMS communications for requested service, project, account, meeting, security and operational purposes, including confirmations, reminders, time-sensitive updates, authentication or security codes and replies to enquiries. The public SMS Opt-In page currently documents the intended consent language; its example fields do not submit, enrol or store consent.

When the program becomes active, participation will be optional and based on a separate, affirmative opt-in. Entering a telephone number in the general contact form will not itself enrol a person. Consent will not be a condition of purchase or service, except where the messaging service itself is specifically requested. Message frequency may vary. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

STOP, HELP and support

Reply STOP to opt out. You may receive one final message confirming the opt-out. Reply HELP for assistance, or use our contact form. For the consent language and program details, see SMS Opt-In.

Privacy

Our handling of personal information, including mobile numbers and SMS consent data, is described in the Privacy Notice. SMS opt-in and consent data is not sold or shared with third parties for their own marketing or promotional purposes. We may share data with service providers necessary to deliver the messaging service.

Governing law and consumer rights

These terms and any non-contractual dispute connected with the website are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, subject to any mandatory rights or forum protections available to you under the law of your country of residence. Nothing in these terms limits statutory consumer rights that cannot lawfully be waived.

General

If any provision is held invalid or unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver. These terms do not create rights for third parties. English is the controlling version to the extent permitted by law; translations are provided for accessibility.

Changes and contact

We may update these terms when our website, services or legal requirements change. The date below shows the latest revision. Questions may be submitted through our existing contact form; select or state that your enquiry concerns legal terms.
